By purchasing any artwork from me, you are automatically agreeing to these following terms.
Please read carefully, as I will deny your commission if it does not correspond with my terms and conditions. These terms are subject to change at any time. If you have any questions or concerns, feel free to email me at miknic.business@gmail.com.
- I retain the right to deny your commission request(s).
- I retain all rights to my work, which include, but are not limited to, the right to use the artwork for self-promotion and upload it to any of my personal galleries, or portfolio, unless otherwise agreed upon. Let me know before the final commission if you don't want it posted- asking me to take down the completed commission after this will automatically be ignored; meaning around a month after the completion of the art piece.
- You may not use the artwork for commercial purposes unless otherwise agreed upon (permission must be given before the completed commission). If agreed upon, then credit must be given.
- You have the right to use your commission for any personal use (avatars, wallpapers, icons, profile pictures, etcetera), but may not be used for commercial use or go uncredited. Credit must also be noticeable.
What I can do:
- OCs, sonas, multi-fandom fanart, etcetera
- Animals
- Dragons and other fantasy creatures
- Humans, humanoids, and anthros
- Gore
What I will NOT do:
If you are unsure about these limits then feel free to email me
Depictions of:
- Racism
- Incest
- Pedophilia
- Or anything I feel uncomfortable with
Payment Process and Refunds
- Payments are made in USD through PayPal.
- Payment must be confirmed before I start on it.
- I should have your commission done within a week to a few months after the payment and concept have been confirmed- depending on the commission type, contact with other commissioners, and personal circumstances.
- I may not be able to finish a certain deadline on any given specified date, but I will try to meet any reasonable time frame you have in mind.
- Once the concept is agreed upon, full refunds will not be given. You cannot request a refund after the completed commission.
- Once the final payment is confirmed, you cannot change your commission. You may add a few minor details BEFORE I start on the flat colors/rough colors. I can also decline these requests as well if the piece is complex (or other reasons following this).
- If you insist on adding in items or changing parts of the piece that was not already confirmed, then additional payments will be required.
Process
- Once payment is confirmed, I will start on concept sketches. Once a concept sketch has been chosen, I will send progress updates until the commission is done. You must respond to these updates so I know that you have gotten, and approved of, what I have done so far.
- Concept sketches will be sent to ensure the idea is what you requested. Commissions will have multiple concept sketches as well as lighting sketches.
- You must let me know what you want the dimensions to be. If you do not specify this then I will ask you before starting anything. If you do not reply or ignore me then I will automatically set the dimensions to fit what I feel would be best.
Terms of usage for designs:
You retain all rights to the character of any design purchased from me, be it custom or adoptable. However, I still retain the rights to the original artwork I’ve created. That means you cannot use the artwork I created for commercial purposes (like merch or prints) unless otherwise agreed upon.
- You may not resell my works.
- You may not repost without credits (let me know beforehand if you want to repost).
- If the viewer or consumer is not aware that I made this commissioned piece, it will be considered plagiarism. Credit must be noticeable.
Plagiarism/Using My Work
By purchasing my artwork you understand that plagiarizing my artwork in any way, which may include but is not limited to: reposting my artwork on social media without my written consent and/or credit, using my artwork without written credit/consent, commercially manufacturing without written credit and/or consent, and claiming any of my art pieces as your own is plagiarism and is illegal by the United States Copyright Act of 1976 and charges can and will be held against you. To be given written consent to do any of the mentioned above, you must sign a contract. By purchasing a commission or any artwork that I have created, you understand the legal consequences of plagiarizing any of my artwork and accept any legal penalty or consequence resulting in the theft or plagiarism of my work. I own all the rights to all of my artwork.
In order to ask for consent to post, use, commercially manufacture, or change my work or create something similar, please email me with your specific intention to obtain written consent or a contract. I have the right to decline any request to use, commercially manufacture, or change my work.
